A 70 year old man with dementia has been left quadriplegic (paralysis of all four limbs) after an x-ray department removed his collar following a fall.
The man, a resident of a care home had suffered a fall so was taken to a hospital in Slough. Whilst in the process of having an x-ray his collar was removed dislocating a fracture in his neck.
The resulting dislocation caused a catastrophic injury to his spinal cord leaving him totally dependent on others for his care.
Prior to the fall, the man was said to be active and chatty to visitors but now he is completely helpless.
The trust in charge of the hospital admitted liability and a representative of the trust has apologised to the man for the “admitted shortcomings” of the care given to him. They have agreed to pay the substantial legal costs as well as £400,000 in compensation.
The barrister has paid tribute to his family for their “outstanding dedication” and commented “It is sad to say the least that his last days should be spent in this degree of indignity”
The injury to the patient in this case was caused by the negligent actions of medical experts and the results are life changing. The significant award to the patient is because the man has a normal life expectancy but the injuries are so severe that he will need 24 hour care for the rest of his life.
If you have suffered an injury because a medical expert didn’t follow procedure or a mistake happened, you may have grounds to make a clinical negligence compensation claim.
